Terms and Conditions of Reservation

BOOKING CONDITIONS 

Procedure

Client: It will be considered a Client who in his own name or on behalf of third parties makes a reservation management of a property marketed by Summerland Apartments, either through the web, email, telephone or any other channel of real estate supply.

Payment of the Service:

1º) Reservation of the property; It is established the amount of 20% applicable on the total (taxes and fees included) as a Reservation. The necessary data for its realization on the part of the client will come collected in the document of Acceptance of Reservation emitted by Summerland Apartments.

The client has a period of 24 hours from the reception of the Reservation Acceptance document issued by Summerland Apartments to make the deposit, deposit or transfer in favor of Summerland Apartments.

After the aforementioned period of 24 hours has elapsed and Summerland Apartments has NOT confirmed receipt of the 20% of the total amount, the reservation will be considered as not having been made by the client and Summerland Apartments will be able to attend other reservation requests for the aforementioned property.

2º) Remaining payment: 80% will be paid by the client at the same time the keys of the property are handed over.

Please do not forget to send to Summerland Apartments the proof of payment for the Reservation, as well as your personal data (Name and Surname, ID or Passport, complete address, telephone and email).

Reservation Cancellation Policy: 

  • 100% refund seven days prior to the rental period between October 1 and February 28.
  • 0% refund less than seven days prior to the rental period between October 1 and February 28.
  • 100% refund one month prior to the rental period between March 1st and September 30th (except July and August).
  • 0% refund less than one month prior to the rental period between March 1 and September 30 (except July and August).
  • 100% refund forty-five days prior to the rental period between July 1st and August 31st.
  • 0% refund less than forty-five days prior to the rental period between July 1st and August 31st.
  • The refund for cancellation will be made within a maximum period of 30 days from the date of cancellation.

-Early termination of the rental period by the Client: In the event of early termination of the rental period of the property by the client, the client shall have no right to any compensation, whether economic or a possible change of future dates for the enjoyment of the period not consumed.

Responsibilities

-Responsibility of the Client for damages caused during the occupation of the property. Once received the apartment the client assumes full responsibility for his actions and those of the guests who occupy the property reflected in the reservation document during the selected period.

Before the effective occupation of the property, the client will have the right to inspect visually all the services that the property has, as well as to check the perfect state of the household goods, appliances, internet connection, or even parking if it were the case. In order to guarantee the possible damages that could occur during the stay, the client will provide in the document "ACCEPTANCE OF PROPERTY" the bank details reflected in a Debit or Credit card of his ownership, being these the card number, the expiration date and the CVV number reflected on the back of the card. Summerland Apartments will proceed to block an amount as a deposit which will be released once the apartment has been checked within a maximum of 48 hours. In the same way, the client will provide his NIF, NIE or passport number.

In case of any damage to the content or container of the property owned or managed in any aspect by Construcciones Hermanos. Agüero S, l, this will make a charge in the bank account of ownership of the client associated with the bank card for the total amount of the damage.

Construcciones Hermanos Agüero reserves the right to take legal action if it deems it appropriate for damages incurred, operating damages, interest or any other.

-Deposit. In order to constitute the corresponding Deposit with which to cover damages that may be caused by the client, guests and/or third parties that may access the property with their consent, the client AUTHORIZES the capture by electronic means of the corresponding debit/credit card provided for this purpose.

Timetable for entry into the property and key handover:

Check-in and key delivery will be from 16:00 pm to 20:00 pm.

A surcharge will be applied in case of exceeding the maximum time defined for key delivery as follows:

Key delivery from 20:00 pm to 22:00 pm: 30 €.

Key delivery from 22:00 pm to 24:00 pm: 60 €.

The amounts shown will be paid at the time of delivery of keys in cash by the customer.

In case of exceeding the established maximum timetable, the entrance to the property by the client will take place from 16:00 pm of the following day, not being able to claim in his favor for any amount whatsoever.

Check-out and key return schedule: 

The time of departure and return of keys: It will be before 12:00 am reflected as the day of end of stay in the property.

For other times, please contact Summerland Apartments.

In case of exceeding the established check-out time, it will be considered sufficient reason for Summerland Apartments to make a supplementary charge.

Location of delivery or return of keys:

The location where the keys will be delivered by Summerland Apartments, as well as the collection of the same will be reflected in the Reservation Confirmation document, which may be in the same property or in the offices owned by Summerland Apartments.

Rules of Use.

Number of guests: The maximum number of occupants accommodated in the property will be the one reflected in the reservation request document made by the client and accepted by Summerland Apartments.

Mascotas o Animales de compañía: No se admiten animales de compañía de ningún tipo salvo los recogidos en la Ley 11/2021, de 28 de diciembre, por la que se regulan los perros de asistencia a personas con discapacidad en Andalucía.

Rules of coexistence:  

The holding of parties is strictly prohibited.

It is strictly forbidden any activity in the common areas of the buildings that may disturb the rest of the occupants of the building such as shouting, playing, singing, etc..,

It is not permitted to deposit personal items of any kind in the common areas of the buildings.

It is not allowed to deposit garbage bags in the common areas of the buildings.

Smoking is not permitted, although in buildings with gardens, terraces or patios, smoking is permitted in these areas.

It is not allowed to park or deposit objects in the common areas of the garages such as bicycles, motorcycles, cars, etc.,

Please use the space specifically designated for drying clothes, do not place them on the terraces or balconies.

In some cases the properties are integrated in residential buildings, respect the hours of rest, as well as the specific community rules of each one of them.

Cleaning: The property will be made available to the client in a clean condition. The client undertakes to leave the apartment in a reasonably clean condition without garbage or food debris.

To be considered. 

  • Specific conditions of the apartment: In addition to the general conditions, we kindly ask you to check the specific conditions of the contracted apartment.
  • Photos and description of the apartment: At Summerland Apartments we verify the apartments and provide the client with a detailed description and updated images so that he/she knows all the details of the accommodation. However, it is possible that there may be some variation with the decoration and equipment of the contracted property.
  • Overbooking: In case of a simultaneous double booking for the same apartment, in this case, Summerland Apartments will provide the client with an alternative accommodation of equal or higher quality.
  • Damages or problems before the beginning of the rental period: In the event of any breakdown or damage to the apartment that would prevent you from staying, Summerland Apartments will provide you with an alternative accommodation of equal or superior quality.
  • Any defects or problems in the apartment during the rental period: We work to provide you with the best quality in your accommodation, in case you have any problem, please call Summerland Apartments for a prompt solution as soon as possible.
  • Responsibility: Summerland Apartments is NOT responsible for any loss or damage to the tenants' belongings deposited in the property or its annexes such as garage, common areas, etc., during their stay for any reason or concept.

Applicable law and competent jurisdiction

These terms and conditions of contract are governed by Spanish Law. Construcciones Hermanos Agüero, S.L. and the Client, for the resolution of any dispute that may arise, with respect to its validity, execution, compliance or resolution, total or partial, submit, expressly waiving their own jurisdiction or any other that, if any, may correspond to them, to the jurisdiction of the courts of Rota (Cadiz).
